Analyzing the Contentious Section 52(1)(za) of the Copyright Act, 1957

In the present article, the author seeks to understand the controversy surrounding Section 52(1)(za), a fair use provision exempting wedding events from requiring a copyright license for the music played therein. A recent judgement involving an Expert is used as the basis and the reasons for dissent are enumerated. Further, the contentious section is looked at from a modern perspective whilst revealing a major drawback and a method to plug the same is suggested.
